Underage Drinking at Ohio University
It’s no secret that Ohio University has a reputation for being a “party school”. While only a small amount of the 20,000+ Ohio University students make the decision to drink alcohol, the label continues to prevail. The biggest problem that students face when they choose to drink is underage drinking because it is against the law and it can lead to binge drinking, alcohol addiction and possible jeopordizing of grades, graduation and future success. Experimentation with alcohol may stem fromĀ being on your own for the first time, the desire to fit in with your peers or to relieve stress, but the danger you will be caught is high and can cost you more than you think. Underage possession and consumption is a misdemeanor in the first degree, the most serious misdemeanor offense, which carries a maximum sentence of $1,000 fine and six months in jail. While this sentence is very rarely imposed, it is still possible.
If you are caught consuming alcohol under the age of 21, the consequences are always high, but they can be even higher if you have a criminal charge already on your record. For first time offenders, the Athens County Municipal Court usually assigns you to complete the Diversion Program. This involves a number of requirements to allow first time offenders to avoid a conviction on their record. If you are offered the Diversion Program, we suggest you sign up and then make an appointment to see one of our attorneys to make sure you understand what is expected of you when you enter the program. Visit our Diversion Program page for details.
For second time offenders, the consequences can be more severe and will exclude you from the Diversion Program. The fines increase and may include jail time.

While the Center for Student Legal Services does not condone underage possession/consumption or any other law breaking activity, we realize that students often make mistakes. We believe that college students are adults capable of making your own decisions and should be aware of your legal rights and be free from undue harassment.
